These Terms & Conditions ("Terms") govern your use of the XPLR Guide mobile application and related services (the "Service") provided by XPLR Guide ("we", "us", "our"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us at support@xplrguide.com of any unauthorized use.
3. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes or to infringe the rights of others.
- Reverse engineer, scrape, or interfere with the Service.
- Upload content that is illegal, harmful, deceptive, or violates third-party rights.
4. User Content
If you submit content (lists, comments, support messages, etc.) you grant us a worldwide, non-exclusive, royalty-free license to host, display, and use that content solely to operate and improve the Service. You retain ownership of your content.
5. Third-Party Services
The Service relies on third-party providers (e.g., Supabase, OneSignal, Mux, Resend, Vercel, Apple App Store, Google Play). Their terms and privacy policies apply to their respective services.
6. Intellectual Property
The Service, including its name, logos, design, and content we create, is owned by XPLR Guide and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee the accuracy, completeness, or availability of place data, recommendations, or itineraries.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, XPLR GUIDE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS.
9. Termination
We may suspend or terminate your access at any time for violation of these Terms or to protect the Service. You may stop using the Service at any time.
10. Changes
We may update these Terms. Material changes will be announced in the app or by email. Continued use after changes take effect means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Davidson County, Tennessee, unless applicable law requires otherwise.
